Nature of the Service

MarkTech Solutions is a Saudi digital solutions and technology platform, providing businesses across all regions of the Kingdom with:

• Professional website and online store development.
• Setting up and managing social media accounts and their content.
• Zero-touch automation solutions for the client's business.
• AI agents, including the automated assistant "Talal" and a team of specialized agents who handle service requests.

These services are provided through fixed-scope, fixed-price subscription packages shown on the Packages page, or through a custom quote for larger requirements.

Requesting the Service and Contract Formation

Filling out a service request form on the website, or contacting us through the AI assistant, WhatsApp, or email, is only an initial request. By submitting the form, you confirm the accuracy of the information provided and agree that our team or one of our automated agents may contact you to discuss the scope of the service before any formal contractual commitment — submitting the form alone does not create a binding contract. A commitment becomes effective only after payment is completed through the website's approved payment gateway, or your written agreement to a custom quote.

Use of AI and Service Agents

Our website relies on an AI assistant ("Talal") and a team of specialized automated agents to respond to your inquiries, receive service requests, and partially or fully automate certain tasks (such as drafting marketing content). Automatically generated replies and output are for guidance and execution purposes within the scope of the agreed service, and remain subject to review by our human team when needed. Use of these tools does not by itself constitute a formal contractual commitment beyond the purchased package or service.

Payment and Subscriptions

Package prices are shown clearly on the Packages page before payment, and payment is processed through a licensed, specialized payment gateway — we never collect or store your card details on our own servers. Monthly or yearly subscriptions are subject to the terms shown at the time of subscription (minimum term, renewal, etc.).

Intellectual Property

All rights to the MarkTech Solutions logo, design, software, and content (including the website's code, the automated agents' scripts, and marketing material published on the blog) are reserved to MarkTech Solutions, and may not be copied or reused without prior written permission.

Websites, online stores, and content we build or publish for you as part of your package or custom quote remain entirely your own property once delivered and paid for in full, per the scope agreed in the package or contract. We may not use your trademark or business content for any purpose outside delivering the agreed service without your permission.

Client Obligations

The client agrees to provide us with accurate and correct information about their business, respond to any clarification needed to deliver the service in a timely manner, and not use our services for any activity that violates the laws of the Kingdom of Saudi Arabia.

Limitation of Liability

Our services rely on automation and AI tools, and may be affected by factors outside our control (such as a third-party outage at WhatsApp or our hosting provider). We make every effort to ensure continuity of service, without committing to a specific numerical uptime percentage — full service-level details are set out in our Service Level Agreement.

Changes to These Terms

We reserve the right to modify these terms at any time, and your continued use of the site after changes are posted constitutes implicit acceptance of them.

Governing Law

These terms are governed by and interpreted in accordance with the laws of the Kingdom of Saudi Arabia, and the courts of the Kingdom have exclusive jurisdiction over any dispute arising from them.
